The following are terms of a legal agreement between You, the individual who use, implement, download, or install the under mentioned Barcode Component, and KeepDynamic.com (hereafter the "KeepDynamic"). By downloading, installing, implementing or using this barcode component product, you acknowledge that you have read, understood, and agree to be bound by these terms of this Barcode Component License Agreement (hereafter the "Agreement"). If you DO NOT agree to these terms of this Agreement, DO NOT use, implement, or install the Barcode Component.

KeepDynamic grants to Licensee (You or the company You may represent) only the non-exclusive, non-transferable, and perpetual right to copy, use, or modify the Barcode Component in accordance with this Agreement. KeepDynamic provides multiple barcode component license types to meet the needs of different companies and implementations. Particular Licenses may be provided for the product depending on the intended use of the Barcode Component.

This license is for evaluation purposes only. Barcode Component that is distributed as shareware or a demo version may only be used for testing the functionality for a period of thirty days only. Integration within end products and commercial use purpose are not allowed

Developer Licenses provide You royalty free use of the Barcode Component for the purpose of application development. You are allowed to use the Barcode Component within your company as well as outside your company bundled with an application. Developer License is licensed by the number of Developers that will use or work with the Barcode Component. Three types of Developer Licenses are available:

• One Developer License
The One Developer License allows royalty-free distribution and use of the Barcode Component for ONE Developer on more than one computer to design, develop and test as many applications as necessary. This license type also allows royalty-free distribution for unlimited user licenses and deployment any number of applications for unlimited servers. Additional Licenses must be purchased for more than one developer using the Barcode Component to create applications.
• Five Developer License
The Five Developer License grants up to FIVE Developers royalty-free distribution and use of the Barcode Component on more than one computer to design, develop and test as many applications as necessary. This license type allows royalty-free distribution for unlimited user licenses and deployment of any number of applications for unlimited servers. This license type is also granted if 2 One Developer License are purchased.
• Unlimited Developer License
The Unlimited Developer License allows complete royalty-free distribution and use of the Barcode Component for UNLIMITED Developers on more than one computer to design, develop and test as many applications as necessary. This license type allows royalty-free distribution for unlimited user licenses and deployment of any number of applications for unlimited servers.
• Small Company Developer License
The Small Company Developer License grants the same right as One Developer License to the organizations with a gross annual revenue or funding of less than 2 million U.S. Dollars.

KeepDynamic offers perpetual and royalty-free distribution to licensees using all Barcode Component license type within licensees' companies as well as outside their companies. Licensees may use the Barcode Component as part of solutions in their development applications, provided that Licensee adheres to the following terms:

• More than one Developer, whose number is less than five, may use or develop with the Barcode Component after purchasing an additional Developer License or the Five Developer License. Five Developer License are recommended for the lower cost than that of double One Developer License
• Five Developers or more may use or develop with the Barcode Component after purchasing the Five Developer License or Site Developer License.
• Licensee must distribute the Barcode Component as a part of solutions of an application and bundle the Barcode Component with an application. Licensee must make sure that the distribution of Barcode Component would not compete with KeepDynamic.

KeepDynamic keeps the ownership of all copyright interests in the Barcode Component Software and the accompanying materials, including any derivative works based upon the Barcode Component Software. Licensee must comply with the License Agreement by downloading, using, implementing and distributing the Barcode Component Software as well as the accompanying materials. Any unauthorized copying or using of the Barcode Component Software, including modified, merged with any other applications is forbidden. Licensee may be legally responsible for any behavior which violates the intellectual property rights and this License Agreement. Reasonable number of copies of the Barcode Component and the accompanying materials used for developing, distributing, or archiving, are allowed under the Developer License Terms.

This Barcode Component License Agreement takes effect when the Barcode Component Software is downloaded, used or when a Developer License is purchased or granted, and is perpetual unless termination has come into force under this License Agreement. Licensee may terminate this License Agreement through returning the Barcode Component Software to KeepDynamic and deleting all copies at any time. Infringement of the License Agreement from Licensee may also lead to the termination. KeepDynamic reserves the termination rights to the Barcode Component Software at any time. However, KeepDynamic is obligated to offer support of appropriate level for the discontinued products for One Year from the discontinued date.

NO WARRANTIES! KeepDynamic claims NO WARRANTIES for the Barcode Component Software. The Barcode Component Software and the accompanying materials are provided "as is" without warranty or representation, either express or implied, as to performance, merchantability or fitness for any particular purpose. The Licensee assumes the entire risk of any damage caused by this Barcode Component Software.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall KeepDynamic be liable for any incidental, indirect, consequential, or special damages (including, but not limited to, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this KeepDynamic Barcode Component product, the accompanying materials, or failure to provide support services, even if KeepDynamic has been advised of the possibility of such damages

KeepDynamic offers a free Priority Support and Product Upgrade to the Barcode Component Software for a period of sixty (60) days from the date of purchase on any licensed Barcode Component product. KeepDynamic offers the Priority Support through email, and guarantees that all support is going to be provided within 24 hours. Priority Support and Product Upgrade to the Barcode Component Software may be offered beyond sixty (60) days if Licensee purchases Priority Support and Product Upgrade Subscription via contacting with support@keepdynamic.com

This is the entire Agreement between Yon and KeepDynamic.com on the Barcode Component Software, the accompanying materials, as well as the technical support services. It supersedes all prior or contemporaneous communications, proposals and representations and shall control any terms of KeepDynamic policies for the product and technical support services which may conflict with the terms of this Agreement.
