EXAMPLE: Assume the following facts: John and Mary Stone are a married couple. John wishes to give his daughter and son-in-law, William and Mary Jones, $60,000 in cash. An individual is allowed to make a cash gift of up to $10,000 to as many different individuals as he or she desires in one tax year, without incurring any gift or estate tax ramif ications. If his or her spouse so chooses, he or she can elect to split such gift, thus increasing the annual exclusion to $20,000 per donee. A Federal gift tax return (Form 709) must be completed to make such an election (see the sample gift tax return*). In this case, Mary consents to split the gift with John. If the gift is made payable to only one of the children, then it is deemed paid to one donee. To further save taxes, the gift could be paid equally ($30,000 each to William and Mary) or made out on a check jointly to the order of Mr. and Mrs. William Jones. Then William and Mary are deemed to be two separate donees; thus $40,000 in total gifts can be made to the two of them without any gift or estate tax ramif ications. On gifts above these annual exclusion levels, a unif ied tax is imposed. However, each individual is allowed to make $60,000, 1999 ($675,000, 2000) of either lifetime gifts, or transfers at death, free of gift or estate taxes.
