3. Day-Ahead Setting of AS Prices Using CAISO s forecast of AS requirements and the producer s AS bids, CAISO had a supply and demand outlook for ancillary services. Prices for these services could then be set at the intersection of the supply and demand curves. 4. Informing Suppliers of Their Status CAISO would inform generators if they were selected or not. In addition to operating the day-ahead AS market, CAISO would operate bidding sessions for ancillary services during delivery date. Remark A regulatory mechanism was necessary for the procurement of certain grid services because it is not possible to create competitive bidding conditions for all grid requirements. Providing reactive power for local voltage support is an example of a grid service that may not be serviced by the number of producers required to create competitive conditions. In fact, there are units that must operate in order for the grid to function. The owners of such units have monopolies and are subject to regulated pricing.

Although there are many forms of psychological injury that can be the focus of a compensation claim (including chronic pain, cognitive impairment, postconcussive syndrome, depression), this review will focus on posttraumatic stress disorder (PTSD). This condition is diagnosed when the individual has (a) suffered a traumatic experience, and subsequently suffers (b) re-experiencing (e.g. ashbacks, nightmares), (c) avoidance (e.g. effortful avoidance of trauma-related thoughts, emotional numbing), and (d) hyperarousal (e.g. insomnia, irritability) symptoms. According to the Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition (DSM-IV; American Psychiatric Association, 1994), PTSD has the distinctive feature of including a precipitating stressor as part of the disorder s de nition. This establishes a straightforward connection between a triggering traumatic event and a variety of observed symptoms (Freckelton, 1997). Such a relationship enables PTSD to be susceptible to both compensation and criminal claims (Bryant, 1996; Erlinder, 1983; McFarlane, 1995). This amenability to compensation claims resulted in the introduction of PTSD in 1980 (DSM-III; APA, 1980) causing considerable concern about potential increases in PTSD-related claims (Lees-Haley and Dunn, 1994; Liljequist, Kinder and Schinka, 1998). These concerns have increased in recent years because claims for psychological injury following trauma have risen dramatically (Neal, 1994). Referring to the North American context, Stone (1993, p. 23) noted that, No diagnosis in the history of American psychiatry has had a more dramatic and pervasive impact on law and social justice than posttraumatic stress disorder . PTSD is an excellent example to discuss many of the major issues that need to be considered in assessing psychological states in the context of compensation claims.

Thus, the legacy of the early years of preventive policing was to create in constables almost a zero tolerance of anyone who looked like he might at some time upset ratepayers. At the same time it created a helpless tolerance of most indictable crimes after they were committed. (Taylor, 1999, pp. 115 116)

When applied to scienti c research offered in the trial setting, the falsi cation criterion contains an added complexity. It is not entirely clear which aspects of the science must have been tested to cross the threshold of admissibility, and which aspects are a matter of weight for the trier of fact to determine. The Daubert Court wrote that the focus, of course, must be solely on principles and methodology, not on the conclusions that they generate (p. 595).

the reliability repair example of Section 2.6. The owgraph is reproduced here as Figure 5.13. Recall that the device is being developed for a given application. The probability that the device fails on any given trial is p12 . If the device fails, it is worked on and there is a probability p23 that it is xed. The states of the system are de ned as follows: state 1 indicates that the trial is successful given that the device is faulty; state 2 indicates that the trial is a failure given that the device is faulty; and state 3 indicates that the trial is successful given that the device is xed. Recall that M11 (s) and M12 (s) represent MGFs of testing times and M21 (s), M22 (s), and M23 (s) are MGFs of repair times. We make the following distributional assumptions for this illustration. State 0 is the start of the process and we assume that every device instantly reached state 1 (i.e., we assume a constant probability 1 and a constant waiting time of 0 to reach state 1). Let Tij be the random waiting time from state i to state j for i = 0, 1, 2 and j = 1, 2, 3. We assume that T11 Exp( 1 ), T12 Exp( 4 ), T22 Exp( 2 ), T21 Exp( 3 ), and T23 Exp( 5 ). The MGF of the distribution of the waiting time from 0 3, the time until the device is xed, was found in (2.29). The system was simulated for 10 realizations and complete data (without censoring) were recorded on each transition. With uniform priors on p11 and p23 and vague priors on all of the other parameters, the posterior distributions are ( 1 |D) Gamma(3, 8.16) ( 2 |D) Gamma(4, 10.91) ( 3 |D) Gamma(3, 7.08) ( 4 |D) Gamma(9, 12.59) ( 5 |D) Gamma(10, 35.13) (p11 |D) Beta(5, 15) (p23 |D) Beta(10, 6).
